To qualify to apply for a representative of an overseas business you will need to satisfy UKVI that the overseas company:

• Is genuine and trading and whose headquarters and principal place of business is outside the UK;
• Has no branch or subsidiary in the UK;
• Intend to establish the company’s first commercial presence in the UK, for example a registered branch or a wholly owned subsidiary;

You will need to show:

• That you hold a senior position within the company (but hold less than a 50% shareholding) and have full authority to make decisions on its’ behalf;
• Have been recruited outside of the UK;
• Have extensive related industry experience and knowledge;
• You do not intend to take employment other than for your business;
• You are competent in the English language to at least CEFR Level A1 (speaking and listening);
• You can maintain and accommodate yourself and your dependants.

You may qualify for indefinite leave to remain after 5 years under this category dependant on the Rules and your applicable circumstances at the time.
