There are two routes to settlement (settlement as an investor or ILR) by investment under the points based system. Firstly, under the Tier 1 Investor route and secondly, Tier 2 Entrepreneur route.
To apply for Settlement as an Investor under Tier 1 or 2 you must show:
- You have been in the UK lawfully for a continuous period of 5 years;
- Accelerated settlement can reduce this period;
- In the 12 month period before the date of application you must not have been absent from the UK for more than 180 days;
- Adequate knowledge of the English language (unless aged 65 or over or mentally/physically impaired);
- Passed the Life in the UK test (unless aged 65 or over or mentally/physically impaired).
What kind of visa will I receive?
You will be eligible to remain in the UK without any time restrictions.
Other things to remember:
If you are absent from the UK for more than 2 years, your settled status will lapse. If this happens then you may be able to apply under the Returning Resident visa category.
Naturalisation as a British Citizen requires a right of permanent resident before any application for a British passport.
